This article addresses pleading compliance with the marking statute, 35 U.S.C. §287. While the Federal Circuit requires a Non-practicing entity to plead compliance with the patent marking statute, such pleading is difficult when the party licensed by the Settlement License does not agree that it infringed or that it is producing a patented article for or under the NPE's patent. This article provides possible mechanisms for pleading compliance in such situations.
