Court Denies Section 101 Motion Filed Against Stylwan's Patents

Posted by William P. Ramey III | May 10, 2021

On May 3, 2021, Ramey & Schwaller LLP, led by counsel Trey Mahoney, successfully defended clients Stylwan IP Holding, LLC and Stylwan IIT, LLC from competitor Stress Engineering Services, Inc.'s motion to dismiss.  Stylwan asserts six related patents directed to marine riser inspection technology against Stress in the Southern District of Texas.  Stress moved to dismiss all asserted claims as unpatentable under 35 U.S.C. § 101.  Stylwan argued that the asserted patent claims met both steps of the patentability analysis under Alice, and Judge Ellison denied the motion.  The case is Stylwan IP Holding, LLC v. Stress Engineering Services, Inc., No. 4:20-CV-03297 (S.D. Tex.).
