Melissa Schwaller was quoted in an article in the SE Texas Record regarding patent agent-client confidentiality privilege. The Texas Supreme Court will review whether attorney-client privilege should be extended to patent agents in the case, In re Silver, Case No. 16-0682. This privilege is already recognized at the federal level. Dr. Schwaller stated “the proposal makes sense because patent agents have passed a bar exam just like lawyers do and have also undergone a character review by the USPTO”.
