Patent trolls, often portrayed as the villains of the innovation world, actually serve an essential function in fostering technological advancement. These entities, more formally known as Patent Assertion Entities (PAEs), provide valuable support to inventors, acting as intermediaries between small inventors and large manufacturers.

The Function of Patent Trolls

Patent trolls purchase patents not to produce products but to enforce these patents against alleged infringers, often collecting licensing fees in the process. While this practice is frequently criticized for driving up costs, Patent trolls play a critical role in the innovation economy by balancing financial asymmetries between individual inventors and large corporations.  What small inventor can afford to enforce their patent?

Protection and Financial Security for Inventors

A significant reason inventors sell their patents to PAEs is the financial protection and liquidity these entities offer. Small inventors often lack the resources to credibly threaten litigation against large companies that might infringe on their patents. There is no evidence that patent trolls make litigation more expensive.  Rather, patent trolls support a dynamic economy where intellectual property rights are clarified, and innovation thrives. Despite the increase in patent lawsuits, this reflects a period of disruptive technology where courts are defining intellectual property rights more clearly.  Without patent trolls, many inventors would never be compensated for their efforts.

Conclusion

While the term "patent troll" carries negative connotations, these entities can play a beneficial role in the innovation landscape. By providing financial security and a viable market for patents, they enable inventors to focus on what they do best: creating and innovating. As the debate around patent trolls continues, it's crucial to recognize the nuanced role they play in supporting individual inventors and driving technological progress.
