We Protect a First Amendment Right; Our Badge of Honor

The recent Bloomberg tabloid article (Lawyer Big Tech Loves to Hate Wears Backlash as 'Badge of Honor') written by Lauren Castle is an irredeemable hit piece, I can only assume paid for and directed by Big Tech. One only needs to look at the few comments to see who was paying attention, which includes Jonathan Stroud from Unified Patents, an organization single-handedly responsible for destroying the hard work of numerous patent owners, a special interest group representing Big Tech.

Yes, my firm has been sanctioned and we are appealing sanctions we believe are improper. That is what the appellate courts are for, to correct district courts that have issued orders in error. I, however, do not expect Ms. Castle to write about any of the appeals we win. That was not the angle of the article, the angle was clearly to bash and harm the professional reputation of one of the few lawyers left who do what I do, take on Big Tech and represent the rights of the individual inventors. And while we all trust our courts to be impartial and to call only balls and strikes, judges are people with their own biases, as we all appreciate from the politically charged environment. How many judges do you see that retire to work with a small start-up and how many retire to work with law firms defending Big Tech?

I agree with Ms. Castle that my concern and the driving purpose of my firm is to give a voice to those patent owners currently denied representation. So I say to Big Tech, bring it on. We are here for the fight. Every patent owner with good infringement claims and validity deserves representation. We will not back down. We will not cave. Every new case will benefit from our experience working every prior case and if a court says we acted incorrectly, we will modify our actions.

Big Tech, including Microsoft, Google, Blackberry, Netflix, Volkswagen, Cisco, and its service provider Unified Patents are here for one thing, to force firms like mine out of business. There are few firms that will provide representation to those patent owners who may not have a multi-million-dollar case. There are not many firms who will take the abuse, but we will, again and again and again. This is our passion. We are to advocate for the unheard patent owner under attack, and Big Tech will stop at nothing to try and get rid of us.

In 2023 I was approached by two opposing counsel who told me that in-house counsel at the Microsoft Corporation was actively seeking someone to file a complaint against me at the United States Patent & Trademark Office's Office of Enrollment & Discipline. This is Big Tech's new playbook, attack the lawyer's license to practice. One need look no further than Jonathan Stroud's comments in the Bloomberg article that I have nine lives or that he wonders why no bar has sanctioned me, to know where this comes from. Actively seeking out peers to attack peers on behalf of corporations is dangerous and should not be tolerated.

Jonathan Stroud's comments that my firm does shoddy work is directly contradicted by the fact that his company seeks settlements with my clients all the time. We are restoring balance to the system, to make patent litigation affordable to all patent owners. We work tirelessly to restore a protected right, a property right, a First Amendment right and we will continue our fight. It is the nature of this kind of battle that firms like mine will be sanctioned repeatedly and we will address the issue when it comes. We will appeal for our clients and our right to continue this fight for patent owners.
